Robert M. Hailey

Rob Hailey has extensive experience litigating a broad range of commercial and real estate disputes, and currently represents clients in business, nursing home litigation, medical malpractice, real estate premises liability, general liability, and insurance coverage litigation in both state and federal courts.  Mr. Hailey has served since 2008 as lead outside counsel for a number of health care management companies which operate skilled nursing, assisted living, and long-term acute care facilities throughout Texas, Oklahoma and Colorado. Mr. Hailey has first-chair experience in all phases of litigation, including jury trials, bench trials, arbitrations, and appeals. He has tried many cases to verdict, and is also known for finding creative solutions to client problems outside of the courtroom.

Before joining the firm in January of 2011, Mr. Hailey was a shareholder in the commercial litigation section of a large Texas law firm and co-chair of that firm’s pro bono committee. He is a member of the State Bar of Texas, Dallas Bar Association, Dallas Young Lawyers Association, Defense Research Institute, and Pepperdine University Law Associates. Mr. Hailey also serves his community and is on the board of the Coppell Baseball Association, where he enjoys coaching Little League Baseball. Mr. Hailey was selected to the Texas Rising Stars list by Super Lawyers, a Thomson Reuters service.

An avid runner, Mr. Hailey regularly competes in marathons and road races across the United States. A six-time Boston marathoner, he has also run marathons in New York, Minneapolis, Chicago, Dallas, Washington D.C. and recently placed fourth overall in his hometown race, the GE Irving Marathon. Mr. Hailey and his wife live in Las Colinas with their four children. They are members of Watermark Community Church.

Noteworthy Accomplishments

  • Currently represents more than 100 skilled nursing facilities and their management companies and affiliates in professional liability, general liability, and non-subscriber claims in Texas state and federal courts.
  • Recently obtained summary judgment on behalf of a hospital in a health care liability claim in which a plaintiff claimed to have sustained multiple complicated injuries during her course of treatment at the hospital. The case included multiple appeals and remained pending for more than five years prior to the entry of summary judgment in favor of the hospital.
  • Represented a large homebuilder in a case brought by the purchaser of a multi-million residential home. The case involved claims of construction defect, fraud, breach of contract and other claims arising out of the construction and sale of the home. After successfully obtaining orders requiring the purchaser to pursue the case in arbitration, the case was dismissed.
  • Recently obtained summary judgment on behalf of the owner of a large apartment complex and its management company in a premises defect case brought by a tenant. The tenant claimed to have incurred more than one million dollars in medical expenses as a result of a light fixture allegedly falling and striking her in the head and neck.
  • Successfully appealed a trial court order denying a motion to compel arbitration and granting the plaintiff summary judgment in lawsuit brought by an investor against a software start-up company.
  • Successfully represented a health care provider in the appeal of the dismissal of a plaintiff’s health care liability claim through multiple appeals, including an appeal to the Texas Supreme Court.
